Probation is one of the most important stages of employment—and one of the most poorly managed.
Many companies include a probation period in the employment contract and then do very little until the expiry date approaches. That misses the entire purpose of probation.
Probation should give the employee a fair opportunity to understand the role while giving the employer enough time to assess performance, behaviour and suitability.
Probation Is a Process, Not a Date
Under the UAE federal private-sector employment framework, probation cannot exceed six months. The first thing HR and managers should therefore know is simple: When does the employee's probation end?
Once that date is known, the company should work backwards. Managers should have enough time to:
- Clarify expectations
- Provide feedback
- Identify concerns
- Give reasonable support
- Make an informed decision
If none of this happens until the last week, probation has not really been managed.
Managers Need to Document Performance
A common problem appears when a manager says: “The employee is not performing.” HR's next question should be: What feedback has already been provided?
Performance concerns should not exist only in conversations between managers. Where there are genuine issues, employers should create a reasonable record of:
- Expectations
- Feedback
- Concerns
- Support provided
- Improvement required
This makes the decision-making process clearer and more consistent.
Don't Assume Probation Means Immediate Termination
Probation does not mean that an employer can simply end employment without following the applicable requirements.
The federal framework includes specific notice requirements for termination and resignation during probation, depending on the circumstances. This is exactly why managers should involve HR before communicating a probation decision.
Confirmation Should Also Be Managed Properly
Probation is not only about termination. Where the employee successfully completes the period, it is good HR practice to formally document the outcome. That gives both the employee and the company clarity.
It also creates a natural point for the manager to discuss progress, objectives, development areas and expectations for the next stage of employment.
Put Reviews in the Calendar
A simple probation framework can include:
It does not need to be complicated. The purpose is to prevent the expiry date from arriving without a clear decision.
